The Practical Importance of Harmonization of Commercial Contract Law

Author (s):

Jan M. Smits

Date:

July 2007

Abstract:

The paper addresses the question: To what extent does diversity of contract law form a barrier for international trade? Put otherwise: would a unified contract law promote international transactions? This argument can be summarized by saying that disparate national laws may lead to higher transaction costs, in particular for SME?s.
